ABSTRACT

In a chapter that deals with regulation and legal issues, it is tempting to quote Shakespeare: “The first thing we do, let’s kill all the lawyers.”* Actually, the trick is to get rid of the right ones and to keep the ones that can actually help. The problem is that the concept of an on-site clinic combines medical, ERISA (Employee Retirement and Income Security Act), employee relations, real estate, contract law, and benefits issues into one project. It is further complicated by the fact that so many of the regulations are at the state level, and they are overlaid and confused, in some cases by the national legislative and rule-making process.
