ABSTRACT

Various government intelligence agencies, law enforcement, and private sector companies engage in the surveillance of electronic and digital communications. Some agencies conduct surveillance on an international scale, for example, the reputed use of Echelon, a satellite-operated technology utilized to listen to oral communications around the globe. Other agencies, such as the FBI, have monitored domestic digital communications through the use of a technology commonly known as Carnivore, subsequently o³cially known as DCS-1000. Also, private businesses monitor network tra³c under a variety of circumstances and for a variety of reasons. Federal and state laws apply to the conduct of each of these e®orts in a di®erent way.
