ABSTRACT

In Ireland, An Garda Síochána may be required to use force to achieve a lawful objective. For example, they can use force to make an arrest, to act in self-defence or to protect others. The definitions and legal basis for the use of force are found in sections 18 – 20 of the Non Fatal Offences Against the Person Act, 1997. It is important to note that all force used must be “reasonable in the circumstances” as the Gardaí believes them to be. The use of force must be proportionate to the objective that is sought. Factors that may assist in establishing whether or not the use of force was reasonable can include:
