ABSTRACT
The courts’ liberal discovery policies encourage both sides to become knowledgeable about the issues, facts, and value of their positions. The best resolution is the parties agreeing to a settlement without the ultimate need for trial, which is a risk for all parties. The litigation system is designed for trials only in cases in which reasonable parties cannot reach an agreement so as to alleviate the vast number of cases, time, and expense.
