ABSTRACT

Unlike adults, juveniles do not have a constitutional right to bail before, during, or after trial. The courts have not granted this set of rights to juveniles. Therefore, if a juvenile is appealing his or her adjudication or disposition, there is no absolute right to bail pending the outcome of the appeal. However, the release of a juvenile while an appeal is ongoing is governed by state law, and state court decisions and practices vary from state to state (del Carmen and Trulson, 2006).
