ABSTRACT

This chapter explores what happens when countries disagree over the risks of genetically modified organisms (GMOs), and the market shifts resulting from GMO trade. Disputes over such trade usually goes before the World Trade Organization (WTO) Dispute Resolution Body, which has and examineds a total of 623 cases that were brought involving food, water, food safety, and agricultural products for human consumption or for use as animal feed as of the writing of this book. Significant about these cases is the subject matter, food and agricultural products, which are critical pressure points of international trade. Moreover, this chapter examinesd the treaties and challenges relevant to the trivialization through the proliferation of GMOs, thereby providing a brief survey of the most relevant treaties and their scope, such as the Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement, the Sanitary and Photosanitary (SPS) Agreement, and the Technical Barriers to Trade (TBT) Agreement.
