It will be seen from Chapter 9 that every employer has a general duty under section 2(1) of the Health and Safety at Work Act to ensure, so far as is reasonably practicable, the health of all his employees. ‘Health’ includes not only physical health but mental health. Failure to consider the mental health of employees could result in action by the enforcement agencies, particularly in the light of the increased attention to the subject by the HSE.
