THE REAL DEAL

I have styled a lot of ice cream, both real and fake. The legal guidelines for food photography used for advertising purposes are very specific. I am not an attorney, and will not recite the law; however, I can offer an interpretation to give you an example of how the law applies to food advertising. For instance: If you are selling ice cream, you must photograph the real thing, but if you’re selling the topping on the ice cream, you can use fake ice cream.
