ABSTRACT
INTRODUCTION Building surveyors and other people dealing with the technical side of building defects should be aware of the legal minefield that surrounds the issue of maintenance and repair in residential properties. There are a number of statutes, as well as common law principles, which govern matters relating this general area. They overlap to a certain extent, and they approach the problem from different perspectives. All of the relevant statutes have different definitions and most use different enforcement procedures.
