ABSTRACT

This chapter outlines some of the environmental controls. Two policy ideas form the background to environmental controls; the adoption by Parliament of an integrated pollution control in the Environmental Protection Act 1990 and the Environment Act 1995; second, the development of the legislative programme of the European Union on environmental protection. The latter programme included directives relating to a requirement for environmental impact assessments for major development schemes; environmental impact asse ssment s are consid ered in Chapte r 7. A numb er of legislative provisions give powers to deal with contamination of land, noise, pollution of water supplies, and the atmosphere, and the storage and use of hazardous materials. Although these controls are largely additional to planning control, proposals involving environmental risks are carefully considered at a planning application stage. The Environmental Protection Act 1990 attempted to integrate various statutes such as the Control of Pollution Act 1974 and the Health and Safety at Work, etc. Act 1974, with the aim of providing an integrated system of environmental protection of nature and the conservation of scarce resources.
