ABSTRACT

Distinction should be made between old long term improvements — those carried out before 1 March 1948 and those called new long term improvements — those carried out after 1 March 1948.

8.2 Old long term improvements (schedule 9 Part I, 1986 Act) — these are major improvement works, such as building erection and are still frequently encountered despite being over 60 years old. If the consent given was an open one and did not specify agreed terms of compensation or is under custom, then paragraph 2 of schedule 9 to the Agricultural Holdings Act 1986 provides that the compensation payable shall be ‘an amount equal to the increase attributable to the improvement in the value of the Agricultural Holding as a holding, having regard to the character and situation of the holding and the average requirements of tenants reasonably skilled in husbandry’.
