In this chapter we consider legal and contractual aspects of benchmarking and the use of external consultants as benchmarking facilitators.

Except for internal benchmarking studies where legal issues are unlikely to apply, it is important to be aware of the legal issues surrounding benchmarking. The two key issues are confidentiality of data and information shared between participants and national or international laws of data and information sharing.
