ABSTRACT

Planning proposals which will eventually involve the compulsory acquisition of land may very well depreciate the value of a property or even make it virtually unsaleable. Such depreciation will be ignored, under section 9 of the Land Compensation Act 1961, in assessing the compensation when the property is actually acquired. But this will not help the owner to sell the property in the open market in the meantime. For instance, the owner-occupier of a house affected by such proposals may, for personal reasons, be obliged to move elsewhere and may suffer considerable hardship in having to sell at a very much reduced price.
