ABSTRACT
This chapter has three primary objectives. The first is to ascertain the meaning of the principle ‘common heritage of mankind’ (‘CHM’). The second is to assess the advantages and limitations of CHM as a legal response to the greenhouse effect. The third objective is to suggest a new principle of international environmental law (based on CHM), a principle which comes closer to addressing some of the specific legal and ethical problems raised by the greenhouse effect.
