ABSTRACT

One may identify two definitions contained in legislation in Europe. The first refers to the illegal smuggling of foreigners as an activity that deliberately intends to facilitate, in order to gain entry, the possibility of permanent residence and employment in a given country in such a way as to infringe the legal provisions of that country. The second, on the other hand, relates to the traffic in human beings as an activity whose main aim is not only to facilitate and encourage illegal entries but that is also directed, through extremely serious means of coercion (such as violence, threats and abuses), towards the commission of crimes or the exploitation of the subjects concerned.
