ABSTRACT

This textbook is intended to aid those students studying the law of evidence that may have acquired some knowledge, but who still feel that they need more confidence in handling it correctly in assessments. You will be shown how to apply the law to both essay and problem questions. There is an emphasis on problem questions in this textbook so that you can gain as much practice as possible in reasoning with facts as well as law. The practising lawyer is concerned most of the time with facts rather than law. Even in law examinations, analysis of a factual situation is essential to the application of the law, and it is often at this stage that students go astray.
