Burden and Standard of Proof 2 INTRODUCTION The burden and the standard of proof are two matters that must be kept distinct from one another. Judges have a duty to direct the jury in respect of each of them. Problems are therefore most likely to arise in criminal jury trials because a wrong direction was given, or no direction was given at all, both of which could provide successful grounds on which to appeal.
