ABSTRACT

INTRODUCTION The main focus of freedom from discrimination is based on the economic aspect of employment and sex discrimination. However, you should look at Chapter 2, where the protection of fundamental rights was identified as one of the general principles of Community law. The general principle has a wider meaning than merely discrimination based upon sex. This chapter concentrates on the general principle of equal pay for equal work for men and women, laid down in Art 157 TFEU, and the directives issued to provide the detail required for the full implementation of this principle. Generally, the questions asked on this topic are of an essay type, because of the wider knowledge of national employment law normally required for problem questions. Such questions are more likely to arise in employment or industrial law papers. However, it is possible for questions to be constructed in a way that deals specifically with Community law.
