ABSTRACT

To establish the level of judicialisation of the WTO DSU, it should also be considered in relation to other international dispute resolution bodies. A comparison with the characteristics of these bodies will help determine the extent to which it can be truly claimed that the DSU represents a judicialised system of dispute resolution. As there are many organisations involved in dispute resolution at the international level the following cross-section of organisations will be considered: the European Court of Justice (ECJ), the International Court of Justice (ICJ), the North American Free Trade Agreement (NAFTA), the Common Market for Eastern and Southern Africa (COMESA), the Convention on International Trade in Endangered Species (CITES) and, finally, the Convention on Biological Diversity (CBD).
