ABSTRACT
Whether we are concerned with a civil or a criminal trial, it is important to establish at the outset which party bears the burden of proving a particular issue. Furthermore, it is equally important to understand the standard to which the burden of proving a certain issue requires to be discharged. It is these two issues that will be explored in this chapter.
