ABSTRACT
Disillusion with the efficacy of traditional regulatory structures in recent decades has resulted, in many jurisdictions, in the introduction of “zero tolerance” policies. The purported goal of such policies is essentially to eliminate evasion, by stepping up enforcement while severely restricting or eliminating the discretion available to rule enforcers. Zero (or near-zero) discretion is an inherent part of most zero tolerance policies.
