CD 81 was introduced to produce a basis to allow contractors to carry out the design as well as the construction. The scheme of the contract is that the employer, either personally or through an agent, produces a performance specication which the contractor must satisfy. He demonstrates how he intends to do this by producing the Contractor's Proposals. Very importantly, as far as contractors are concerned, there is only limited provision for reimbursement of loss and/or expense, although a claim can always be made using common law rights. The contractor was unable to use his preferred system and lost money. The architect is responsible for providing the contractor with correct information. If the contractor does not discover a discrepancy until too late, the employer must pay for any additional costs resulting. Employer and contractor share the duty of informing the other if either discovers a discrepancy.
