ABSTRACT

Forensic psychological assessments are an increasingly important aspect of litigation. Traditionally, this has mainly involved the criminal domain of law where there have been concerns about competency to confess or to be put on trial, the nature of sentencing and the possibility of legal insanity used as a mitigation. Increasingly, the role of substance abuse has exercised many forensic psychologists, but a major area of growth concerns workers’ claims for compensation for physical and psychological injury. Associated with the growth in this area has been a developing need for expert psychological assessments in relation to various forms of discrimination and the failure of employers in their duty of care.
