ABSTRACT

Civil Liability Someone suffering personal injury or property damage following an accident as a result of building work or associated activities either on or near to the highway may find it possible to seek a legal remedy for the injuries sustained, against one or more of the following:

(i) the building owner, ie the client; may be the owner of the site or just the occupier with the obligation to repair;

(ii) the contractor or sub-contractor; (iii) the construction professional, eg the architect, engineer or

surveyor; (iv) the Local Highway Authority.
