Having considered how an express trust is formed, it is now time to discuss how that type of trust is managed. The managers of the trust are the trustees. Trustees are subject to a number of duties of both a fi duciary and non-fi duciary nature. They enjoy a number of powers. To gain a holistic view of the trustees’ obligations and powers, you should read Chapter 9 immediately after this chapter.
