ABSTRACT

This chapter details and investigates the laws criminalising fictional child pornography (‘FCP’) in four Western countries. It explores the scope and elements of these crimes and makes some preliminary comparisons. This review will provide a knowledge base for the integrated discussion to follow in Chapter 4. While this chapter examines each jurisdiction individually, Chapter 4 looks across the jurisdictions to critically analyse emerging themes. This chapter is structured chronologically starting with the country that first gave any meaningful legal or judicial attention to the criminalisation of fantasy material. Thus, the order is as follows: Canada, the United States, Australia, and, finally, the United Kingdom.
