This and the following chapter will apply the theories discussed in Chapter 6 to examine the possible justifications for prohibiting, or not prohibiting, fictional child pornography (‘FCP’). The focus of this chapter is on the Harm Principle, while Chapter 8 considers the Offense Principle and Legal Moralism. The applicability of the Harm Principle to fantasy material warrants a chapter of its own because, as will be seen, while it is fairly straightforward to show that FCP is offensive or immoral, whether such material is sufficiently harmful to fall within the scope of the Harm Principle is contentious.
