ABSTRACT

Once the CBD was adopted, provider countries started to develop ABS regimes to implement the convention. Thus far realization of the ABS concept has depended mainly on the performance of provider countries. The process of transposing the international agreement into national legislation is a long and difficult one. Successful cases are rare even when the concept has been implemented, and this has led to discontent in the international community. Complaints have arisen on both sides, provider and user, about the functionality of the approach. The international negotiations seem to indicate that users will have to assume more responsibility in the future. However, no agreement on a future regime has yet been concluded.
