ABSTRACT
The Rome Statute directs the Prosecutor to take into account the “interests of justice” when deciding to initiate an investigation or to proceed with a prosecution after undertaking investigations. Experts disagree as to how this phrase should be understood, but the ICC Prosecutor’s office has interpreted it quite narrowly, setting out its position in a policy paper in 2007.
