ABSTRACT

This chapter explains what is meant by commonhold. It explores why commonhold was introduced. The chapter discusses the main elements involved in a commonhold association. It examines what is meant by a community statement. The chapter describes how commonhold comes to an end. The property can be sold in the normal way but the new owner must accept the association and the responsibilities of commonhold. Commonhold is a new approach to community property holding. There are some restrictions on the way an owner of commonhold can deal with the unit that he owns. As a consequence, the site of the proposed commonhold has to be “legally cleared” of existing leasehold interests so that there only remains the freehold fee simple which can then be the basis to establish the commonhold on the freehold land by what is a second registration of title.
