ABSTRACT

There was a challenge to the legality of the Hunting Act 2004 which had been passed under the Parliament Acts. It was argued that Parliament could not use the 1911 Parliament Act to pass the 1949 Parliament Act and that any legislation passed by virtue of s 2 of the 1911 Act was only delegated legislation. The House of Lords held that Parliament had power to amend the 1911 Parliament Act to the extent of the amendment contained in the 1949 Act.
