ABSTRACT

AIMS AND OB ECTIVES The chapter aims to show that the institution of marriage is widely recognised across the world in a number of global and regional declarations, convent ions or treaties. Recognition in Europe occurs both in the European Convention on Human Rights (ECH R) and in EU jurisprudence. Figure 14.1 provides an overview from which it can be seen that questions of the right to marry and found a family arise in connection with a variety of circumstances including:

• prisoners

• consanguinity

• migration and asylum-seeking

• separation and divorce

• transsexuals

• treatment of persons in situations analogous to marriage

• taxation.
