Key Law A foetus is not a person and there is no liability for murder or manslaughter for killing a foetus. However, where the foetus suffers an attack while in the womb, is afterwards born as a living child, but then dies as a result of the attack on it when it was a foetus, D can be liable for murder or manslaughter depending on his intention.
