One'sfirstreactiontothisisamazement.Howisitpossiblefor thecannystudentwhodiscriminatessoskilfullytheprovedfrom thedubiouswhenreadingalegalwritertoswallowatagulpa yearningfor_pre-natalserenitywhichisnotonlyunprovedbut unprovable?Howcanthesamemindwhichcutsthroughruleand legalconcepttobaredecisionacceptasdogmaticMust-Be'ssuch stereotypedpsychoanalyticconceptsaswomb-yearning,fatheromnipotence,father-substitution,lawasthefather-substitute-- acceptthemasapplyingnottosomepersons,buttoalmostall. Thebasicfallacyofwhole-hogpsychoanalytictheoryistheassumptionthatwhatmaywellbepossiblyorevenprobablyoftentrue isalwaysoralmostalwaystrue.Maybe;but,pendingproof,the manwhohaslearnedtheunreliabilityofgeneralizationsinthe lawcanbestremainskeptical.Irecognizetheunwisdomandunfairnessoftalkinginthelooseabout"thepsychoanalysts"or "psychoanalytictheorizing."Irecognizethatastrongcasecan bemadeforpsychoanalytichypothesesandconceptsasveryuseful "asif"conceptswhichhelptheuserindealingwithconcrete situations,andsoassomewhatrelatedtothetheoriesandconcepts,say,ofmodernphysics.YetIstandtomyposition,asto theirutilityfortheoutsider.Theyaretobehandledwithgloves andcircumspection.Fewindeedevenofthepsychoanalyticwriters orthinkersrecognizetheseconceptsandtheorieshabituallyas fictions.Fewindeedrecognizetheiressentialdifferencefromthe fictionalconceptsofphysics.Theconceptsofphysicsarevery

carefullydefined,andareusedwithasustainedeffortatconsistencywithallrelevantobservation.Thepsychoanalyticconceptsarenotcarefullydefined,andareregularlyinconsistentwith agreatbodyofrelevantobservation,andareavailableinmutual inconsistencyfor"application"toconcretesituationsorfor"explanation"ofsuchsituations.Theyare,inthis,subjecttoallthe ambiguityanduncertaintywhichFrankhimselfcastigatesin "rulesoflaw"andwhichallcarefullegalthinkershavepointed outinlegalmaxims.Onlyart,experience,"judgment,"givethe wherewithaltodeterminewhentoturntowhich.(Whichiswhy psychoanalytictherapeuticsandlegalpracticesofaroutruntheir respectivedogmatics.)Thismeansthattheyarerichsourcesof suggestion,condensationsofmuchexperience.Assuchthose notedabovehavevalueinthispresentbook.Itmeanssimultaneouslythattheyareuntrustworthybasesofbuilding-condensationsofonlysomeexperiencewhichisnottypicalofall.And untrustworthytheyprovethemselvesinthisbookbydistortingat timeseventheauthor'sobservationoflegalphenomena.
