ABSTRACT

On a Friday night in September, 1980, a few blocks west of Morningside Park in downtown Miami, Florida, V. W., age 24, was shot dead with his own gun. It seems that he and R. J., 30, had got into a pushing match that escalated into a fist fight. R. J. was winning—the witnesses were agreed about that—when V. W. pulled his pistol. He never got to use it. R. J. managed to wrestle the gun away and gave his younger adversary a pistol whipping, and then some mutual acquaintances stepped in and got them separated. It looked like the hostilities were over, but R. J., still incensed, suddenly snatched up V. W/s pistol and fired (Wilbanks, 1984, case 361).
