ABSTRACT

In this chapter we begin by elucidating the structural conflict notion of 'class rule in other-than-class terms'. Then we consider how pre-trial and trial proceedings reproduce capitalist class relations and seIVe ruling-class interests. In the final section we review sentencing studies in the light of instrumentalist and structuralist interpretations of structural conflict theory for what they reveal of the operation of capitalist, patriarchal and neo-colonialist structures of dominance.
