ABSTRACT

When the Democrats’ health care reform bill was signed into law in March 2010, Republicans in Congress remained uniformly opposed and polls showed that more people opposed the law than favored it. Democrats argued that health care reform was the law of the land and that citizens would soon see the benefits of insurance reform, increased access to health care services, and moderating costs. Republicans claimed that the health care reform package when implemented would raise taxes, deficits, and insurance rates, reduce medical innovation and lead to rationing of lower quality care, and drive the states into bankruptcy. But even after the law was signed, Republicans had one more arrow in their quiver. They contend that the health care bill passed by the Democrats in Congress is unconstitutional.
