ABSTRACT

Forms 12–18 and 22–24 are based upon five JCT forms, counting JCT80 as one form for this purpose. JCT 80, IFC 84 and MW 80 all represent the conventional or traditional contractual arrangement, where the Architect designs and the Contractor builds to that design. JCT 81 represents the ‘fast track’ or ‘design and build’ concept, where the Contractor takes over the design function of the Architect. Under JCT 87, the Architect designs and the Management Contractor builds to that design as in JCT80, but the Management Contractor is remunerated by a fee, and the Contract is entered into on the basis of an estimate of prime cost rather than an ascertained Contract Sum. The Management Contractor is also relieved of a very great deal of his risk and responsibility, especially with regard to the Works Contractors who actually execute the Works as sub-contractors to the Management Contractor.
