ABSTRACT

[9.01] Introduction. With regard to the formalities required in a simple contract for the supply of goods, a sharp contrast may be observed between the SGA and the CCA. As to ordinary sales within the SGA, required formalities are the exception (see para 9.02 , et seq.); but, in the case of regulated transactions, compliance with extensive formalities is seen as an essential measure of consumer protection and is therefore the norm (see para 9.06 , et seq.). In the absence of the consideration necessary for a simple contract, 1 ownership of goods may be transferred by gift 2 or deed.
