ABSTRACT

This question takes us to a second point. Legitimacy is a legal and political concept. Legal notions such as due process relate to democratic political values. This raises the problematic issue of the fundamental values of the Union. Is the EU a democratic order capable of developing so as to become open and transparent to its citizens? To what extent are its political and administrative processes ‘self regulating’ or open to legal challenge? The most recent attempt to reorder the Union has been to orientate EU law towards human rights. The question remains whether this approach is capable of providing a coherent foundation for EU law and its political order.
