ABSTRACT

There is no universally accepted definition of nationality, although there is a general agreement that nationality constitutes a legal bond creating reciprocal rights and obligations between an individual and a state. In the 1929 Draft Convention prepared by the Harvard Law School nationality is defined as ‘the status of a natural person who is attached to a particular state by the tie of allegiance’: art 1 on Nationality, Responsibility of States, Territorial Waters, Spec Supp to (1929) 23 AJIL 22.
