ABSTRACT

In the scheme of the CPR the use of the word ‘conference’ is deliberate. It signifies that the case management conference is intended not to be a hearing in the formal sense but rather a ‘round the table’ conference, chaired by the procedural judge,3 at which the parties, their attorneys, and possibly also those funding the litigation, are present, and where the emphasis is on a co-operative effort to consider the needs of all the stakeholders in the litigation.
