ABSTRACT
Insurance is a highly specialised field. Although the details of policies are best left to the experts, it is essential that the employer and the contractor know their respective rights and obligations under the contractual provisions. SBC and DB deal with indemnities and insurance in clause 6 and schedule 3. IC and ICD deal with them in clause 6 and schedule 1, and MW and MWD deal with them in clause 5 in each case. They can be broken down into the following parts:
• indemnities – injury to persons and property; • insurance – injury to persons and property; • insurance – liability of the employer (not MW or MWD); • insurance of the Works – new Works – existing structures; • remedies if a party fails to insure.
