ABSTRACT

Section 142 of the 1994 Act substitutes a new s. 1 to the Sexual Offences Act 1956 and subsequently gives a new definition to the offence of rape. Under s. 142 it is an offence for a man to rape a woman or another man whether by vaginal or anal intercourse where the victim does not consent to it and the offender either knows the victim does not consent or is reckless as to whether consent is given. It will also be rape if a man induces a married woman to have sexual intercourse with him by impersonating her husband.
