ABSTRACT
Public order and the rule of law are reasonably settled legal concepts. National security is not. This creates difficulties when it is sought to balance these competing features of Western democracies. This chapter describes the history of the clash between law and power, how the rule of law may be under threat by realpolitik, and why its role should be strengthened.
