ABSTRACT

Victim resistance—or lack thereof—is an important component of assault cases, especially sexual assault. The definition of resistance and force is statutorily defined as well. This chapter helps the reader understand different types of resistance, as well as why a victim might not resist. Verbal resistance and nonverbal resistance are discussed, as well as the three responses to threat—freeze, flight, or fright. Some barriers to resistance are also highlighted, as well as suggestions for how to elicit the victim’s resistance.
