ABSTRACT

This chapter looks at the tendering and negotiating process for an offshore construction contract and discusses the issues and factors that the parties will need to address at each stage. It considers the legal issues around when a binding contract is concluded and what may prevent or delay that from happening. The chapter also discusses the structure of the contract, in particular the various other documents that may be incorporated and how they will be interpreted to demonstrate what the parties intended. The final section looks at the financing of the construction. This is a key factor in the success of any such project.
