ABSTRACT

The various branches of the transport industry are subject to widely differing and partly abnormal conditions of competition. A distortion of the natural conditions of competition between the individual undertakings of the transport industry is primarily caused by the fact that the working conditions in comparable functions of the various branches of the transport industry still differ very widely. An equalization of the conditions of competition in non-scheduled traffic may be facilitated by means of freight agencies. The chaotic conditions of competition, war damage and indirect repercussions of the war, as well as the extraneous charges which are in many cases imposed on public transport have caused considerable deficits on the majority of European railways and other public transport undertakings. In order to arrive at an assimilation of the conditions of competition, a unification of the regulations governing civil liability of all branches of the transport industry is indispensable except where natural differences justify deviations from the rule.
