ABSTRACT

Metaphorically, law may be seen as an artificial intelligence (AI) system, and jurisprudence, as the study of the computer science of that system. Arguably, the closeness of analogy between AI and law reflects a common set of problems that have to do in part with common approaches to the nature of the human mind. Both AI and law have run into the limits of formalism, and both are experimenting with new strategies for remaking themselves in nonformalist images. Whatever results these strategies may ultimately produce, the experimentation process is bound to shake up the thinking of practitioners in both disciplines. Any metaphor of law reveals certain aspects of law and hides others. By revealing new aspects or combinations of aspects of law, new metaphors such as those developed may enable to see new possibilities and opportunities for legal change.
