ABSTRACT

This chapter addresses equality of educational opportunity for members of historically disadvantaged groups based on race, gender, national origin, sexual orientation, and first language. The chapter surveys the equal protection rights of students, along with affirmative action policies, classification by age and ability, remedies for de jure and de facto segregation and other forms of race-based discrimination. Anti-discrimination statutes including Title IX, Title VI, and Title VII, along with the rights of English Language Learners (ELLs) under the Equal Educational Opportunities Act (EEOA) are also explored.
